As of May 2025, major changes to Italian citizenship law (Law 74/2025) now restricts eligibility for citizenship by descent. If you or your family members are pursuing Italian citizenship, we strongly recommend reviewing your case with one of our experts.
The new Italian law limits recognition to applicants with Italian parents or grandparents who were exclusively Italian citizens. The process is no longer automatic for many descendants.

Note: Under Law 74/2025, Italian citizenship is no longer automatically passed to children under 18. Parents must now formally declare their intent to transmit citizenship within one year of the child’s birth.
If your application wasn’t submitted by March 27, 2025, and you were born abroad with Italian genealogy beyond grandparents, or your ancestor didn’t hold exclusively Italian citizenship at the time of your birth, you may no longer qualify. However, exceptions exist if your parent resided in Italy for two consecutive years after acquiring citizenship. Each case must be evaluated individually.
You may still qualify through a judicial petition in Italian courts. While not automatic, cases involving a female ancestor born before 1948 may be eligible through legal appeal. Note that even 1948 cases filed after March 27, 2025, may face Law 74/2025’s new restrictions, including the requirement that your Italian ancestor held exclusively Italian citizenship and limitations on claims beyond grandparents. Not automatically. As of Law 74/2025, you must declare your intent at the Italian consulate within one year of your child’s birth. Otherwise, they may need to qualify through residency in Italy and language proficiency. (For children born on or before March 27, 2025, parents who already have Italian citizenship recognized or filed their request by March 27, 2025, have until May 31, 2026, to declare their intention to transmit citizenship.)
